DEED OF PARTIAL PARTITION IN A HINDU UNDIVIDED FAMILY WHERE ONE OF THE COPARCENERS SEPARATES FROM THE FAMILY AND THE OTHERS REMAIN JOINT
THIS DEED OF PARTIAL PARTITION is made on the ____ day of _____
BETWEEN
Mr.______, S/o______, R/o_______ of the first part, herein after referred to as the "first party", which expression shall including his legal successors, executors and assigns.
AND
Mr.______, S/o______, R/o_______, Mr.______, S/o______, R/o_______,
Mr.______, S/o______, R/o_______ of the second part; all three hereinafter collectively referred to as "second party" which expression shall including their related successors, heirs, representatives and assigns.
The first party and second party shall collectively be referred to as parties.
WHEREAS
1. The parties named above constitute a Hindu undivided family ruled by Mitakshara School of Hindu law, owning assets valuing Rs. ______ as given in the Schedule A to this deed.
2. The first party, under the law can get ¼ shares in the property /assets of the Hindu undivided family. The first party intends in separating his connection with the family by taking away his ¼ share of the properties, thus leaving the balance ¾ share of the said properties to the second party. The second party shall continue to be a Hindu undivided family as was before and the parties have themselves consented to partition the family properties state above.
NOW THEREFORE THIS DEED WITNESSES AS UNDER:
1. That the parties now have divided themselves by metes and bounds the total assets /properties of the family as given in Schedule A hereto, in the following manner:
Party of the first part………… All the property given in Schedule I
Party of the second part…..……All the property given in Schedule II
2. That each of the above stated parties shall be complete owner of the property shared by them as given above, and the other party shall not have any rights, title or interest in these assets after it.
3. That this partial partition has been done by mutual agreement, leaving no power to any party to assail it on any reason whatsoever.
4. That the second party shall keep the original deed of partial partition. The first party shall keep a true copy of this deed, duly signed by both parties which true copy will be considered effective as original deed for all purposes and intents.
