Getting a divorce in India

 Though divorce rate in India is just 1.1 percent among the world average, within India, the divorce rate is increasing. Is it a cause of concern? Can anyone do anything about it? This is the debate one would see in soap operas in popular television channels in India.

          Sociologists say that breaking join family system in the liberalised economic scenario, is the culprit with both the spouses earning their livelihood, there is so little space and time available for understanding and sharing.

          Women’s rights activists argue that the increasing divorce rate in India is a natural outcome of the struggle for independence of women and the refusal of male chauvinistic Indian society to recognize the equal status of women in the family.

         One hopes that adding “irretrivable breakdown of marriage” as a ground of divorce will help the divorcing couples to get the order without making  any allegation against each other.

  1. Divorce is agreed mutually under 13(B) , then court deisre to wait for 6 months (Cooling Period). Now how this 6 month cooling period can be waived off because there is ” irretrivable breakdown of marriage”. This is a case of GREEDY and UNEXPECTED ACTIVITIES OF THE GIRL AS SHE WAS HAVING SERIOUS Uniral Tract Disease and nor she was prepared to go doctor, as I feel she was afraid that if She goes to doctor then Doctor’s treatment papers will be evidence of the problems, which her parents had not shared before marriage. Advocate hired by them is misleading and far off from system of justice for which one goes to court.

    No law speaks about waivel of 6 month cooling period in case of mutually agreed divorce cases.
    Please advice on this issue which can quoted to Judge for deciding this case at the earliest. Delaying is DAY LIGHT ROBBERY CASE of YOUNG TIMES of a educated person when SEX urge is maximum .
